The copyright status of the birthday song has long been a problem for independent filmmakers in particular. A filmmaker who wants to include the song in a film is faced with the Hobson’s choice of either paying a license fee for the music synchronization rights or cutting the song out of the film and possibly compromising the artistic integrity of the work.
